In spite of recent efforts to promote cooperation between universities and industry, Germany still lacks a sufficient legal framework for regulating potential conflicts of interest resulting from university-industry cooperation. Prospective regulation of conflicts of interest has to take into account specific constraints imposed by the German constitution. It has to follow stringent procedural and material requirements and carefully weigh the individual researcher’s right to academic freedom against the public demand for objectivity in research. Because of this cautious consideration of the (...) conflicting interests constitutionally mandated in Germany, a potential regulation legitimate in this country may serve as a model for other countries facing the need of the adoption of such a regulation. Die allogene Transplantation von Blutstammzellen aus dem Körper von Kindern, die der Spende nicht selbst zustimmen können, in den Körper eines kranken Geschwisterkindes wirft schwierige ethische Fragen auf. Wie kann ein risikobehafteter, fremdnütziger medizinischer Eingriff ethisch gerechtfertigt werden? In dieser Arbeit werden Argumente kritisch untersucht, nach denen das Spenderkind eine Pflicht habe, bei der Transplantation mitzumachen. Die Idee der Pflicht ist nachvollziehbar aus der Perspektive der Eltern, die zwar in einem Fürsorgekonflikt sind (ein Kind zu Gunsten der Rettung des anderen (...) verletzen zu müssen), aber selbst eine Pflicht haben, für das Leben des kranken Kindes zu kämpfen. Eine Analyse des Pflichtbegriffs zeigt jedoch, dass die Erfüllung einer Pflicht daran gebunden ist, entscheidungskompetent zu sein. Drei Wege werden untersucht, eine solche Pflicht dennochzuzuschreiben: i) die Eltern übertragenihre Pflicht auf das Kind; ii) die Interessen des Spenderkindes implizieren eine Pflicht; iii) Geschwisterkinder haben aufgrund ihrer vertrauten Familienbeziehungen Pflichten untereinander, die auch die Pflicht zu spenden beinhalten. Alle drei Zuschreibungsstrategien werden als unhaltbar kritisiert. Das Ergebnis lautet, dass die Pflicht, einem Geschwisterkind Körpergewebe zu spenden, einem nicht-einwilligungsfähigen Kind nicht zugeschrieben werden kann. Andere philosophische Ansätze zur Stammzellspende von Kindern an Familienangehörige müssten entwickelt und geprüft werden. (shrink)

This book is a comprehensive study of the writings of Jean-Paul Sartre. As well as examining the drama and the fiction, the book analyses the evolution of his philosophy, explores his concern with ethics, psychoanalysis, literary theory, biography and autobiography and includes a lengthy section on the still much-neglected study of Flaubert, L'Idiot de la famille. One important aim of the book is to rebut the charges made by many theorists and philosophers by revealing that Sartre is in fact a (...) major source for concepts such as the decentred subject and detotalised truth and for the revolt against individualistic humanism. Dr Howells also takes into account much posthumously published material, in particular the Chaiers pour une morale, but also the Lettres au Castor and the Cranets de la drole de guerre. The work is a substantial contribution to Sartre studies, but has been written with the non-specialist in mind; to that end all quotations are translated into English and gathered in an appendix. In a post-apartheid South Africa, the value of reflective memories and their impact on community history gives credibility to their relationship with personal struggles such as disability, be it physical or political. Shaped by South African Indian heritage, an isolated individualised case of a second-generation descendant’s ability–disability experience is researched and narrated in this article. The respondent, Dr Kasturi Varley is a woman of the South African Indian community, who was born almost 101 years after the first shipload of Indian (...) indentured labourers arrived in the then Colony of Natal. Her memories shed light on a unique Indo-African-European experience. Her indentured paternal grandfather arrived in the African continent in August 1900. Her reflective memories and shared experiences of various episodes of the ability–disability paradigm add to the body of knowledge of the Indian indentured labour system that already exists and partially fills up the prevalent gaps in the research on this topic. Her story is unique in that she worked wheelchair-bound at the International Atomic Energy Agency in Vienna, Austria and subsequently settled in the United Kingdom. This study applied a qualitative research methodology.Contribution: This article provides insight on reflective memories within the domain of social memory and contributes to an understanding of the historiography of the descendants of Indian indentured labourers in South Africa. In 2020, this community commemorated the 160th anniversary of the arrival of the labourers to the Colony of Natal. (shrink)

BackgroundThe global COVID-19 pandemic confronts people with their fragility, vulnerability, and mortality. To date, scales to measure death awareness mainly focus on the anxiety-provoking aspect of mortality cues. This study aims to cross-culturally adapt and validate the Death Reflection Scale, a scale for measuring positive, growth-oriented cognitions of life reflection and prosocial behavior following confrontation with the finiteness of life.Materials and MethodsThe Death Reflection Scale was translated and adapted in a multi-step process to the German language. In this anonymous, cross-sectional, (...) online survey at a large university in Germany, students, healthcare professionals and other staff completed the DRS alongside comparison measures. Multi-group confirmatory factor analysis was used to assess configural, metric, and scalar measurement equivalence across four age and occupational groups. Convergent/divergent validity testing was done via Spearman correlations.Results1,703 participants provided data for a response rate of ∼5%. 24% of respondents were HCP, 22% students. Confirmatory factor analysis showed a higher-order structure of the DRS with a strong general factor and the originally proposed five subscales. Multi-group CFA showed partial metric equivalence across age groups and partial scalar invariance across occupational groups. Non-invariant scales were the Motivation to live, Putting life into perspective, and Legacy subscales. In the convergent validity testing, two hypotheses were fully confirmed, two partially and four were not confirmed. Experiencing a propensity for increased contemplation and life reflection during the pandemic together with spirituality showed correlations of moderate to large size to the DRS and its subscales.ConclusionFurther conceptual work for death awareness to explore the construct’s stability in different population groups needs to be undertaken. However, the DRS can be mostly used to assess positive and growth-oriented aspects of death awareness and death reflection which may be an important avenue when developing counseling and support interventions for groups experiencing a high burden during the pandemic. Centuries before being included in Hugo Grotius’s De iure belli ac pacis and De iure praedae, the subject of reprisal was already being discussed in medieval literature. The aim of this paper is to examine the medieval and early modern practice and theory of reprisal as it developed before and during Grotius’s lifetime. Its first part investigates a number of important foundational elements, such as the issues of definition and terminology, and the common characteristics of a reprisal case. In the (...) second half, the author explores why reprisals were deemed to be a ‘perversus mos’ or ‘bad custom’ and how continued reliance on this practice was nonetheless justified by inserting it into the medieval just war doctrine. The paper does not provide a systematic study of Grotius’s own engagement with medieval reprisal sources. Rather, it should be read in conjunction with another publication in this same volume, ‘Grotius on Reprisal’ by Randall Lesaffer. (shrink)

The IVR did not spring into existence instantaneously. In 1907, Dr. iur. Josef Kohler and Dr. iur. Fritz Berolzheimer observed that the interest in the philosophy of law and in economic philosophy had grown over the past few years and that its future development required the international cooperation of many scholars. Therefore they decided to found the Internationale Vereinigung für Rechts- und Wirtschaftsphilosophie, to be known as the IVR, and its journal, the Archiv für Rechts- und Wirtschaftsphilosophie. Although the journal (...) was established before the end of 1907, the IVR did not come into existence until 1909, when its constitution was officially registered in Berlin by Josef Kohler, Fritz Berolsheimer and Carl Fürstenberg. No doctrine of Pufendorf's is better known than that of socialitas. The reason is that Pufendorf himself declared that socialitas was the foundation of natural law. No interpreter of Pufendorf can therefore avoid dealing with it. Moreover, Pufendorf linked the issue of socialitas to the question of the state of nature, thus raising important issues with both theological and philosophical implications. Given the prominence and importance of this theme in Pufendorf's work, a close analysis of what he meant by it (...) is central to the interpretation of his work, even though this means to pose again a new number of questions already discussed in the scholarly literature. In particular, this article examines the relationship between Pufendorf and Hobbes with regard to this central theme. In fact, a traditional historiographic topos is that Pufendorf and Hobbes fundamentally disagree on the doctrine of socialitas, while the former is closer to Grotius and to the Aristotelian-classic tradition that see man as a social animal. This article takes, instead, Pufendorf to be a follower of Hobbes, and tries to explain how the more traditional view of Pufendorf as a critic of Hobbes was in some way due to Pufendorf's own attempt to distance himself from the accusations of Hobbesism (and hence of atheism and moral indifference) that the critics made against him when his work first appeared. In order to do this, Pufendorf tried to rethink his own position within the history of ethics, and put himself on the side of the Stoics, of Grotius and of Cumberland, against Epicurus and Hobbes. This retrospective ‘illusion’ has greatly influenced later scholarship, giving us a distorted image of Pufendorf's own view of socialitas. A more precise account of the latter gives a better prospective from which to look at the relationship between Pufendorf and Hobbes. ☆ The publication of this text, in this form, may require some explanation. In what it now appears the very distant June 1989, the Max-Planck-Institut für Geschichte in Göttingen organised an International Workshop on ‘Unsocial Sociability: Modern natural Law and the 18th-Century Discourse of Politics, History and Society’. The proceedings of that Workshop were never published, even though individual contributions have piecemeal appeared since then. My own contribution consisted in a short extract from a chapter from my book Samuel Pufendorf discepolo di Hobbes. Per una reinterpretazione del giusnaturalismo moderno (Bologna, 1990), which appeared in print the following year. For this reason, I considered the separate publication of that intervention as superfluous. Rather naively I underestimated the fact that the publication of my book in Italian restricted its circulation in the Anglo-American academic circles, and even if occasionally quoted, the book would not be much read. Recently, following the solicitations of many friends to present in English part of the theses developed in that book, I had decided to have my intervention at the Göttingen Workshop finally published. After all, this had amply circulated as a manuscript and been cited by many in that form. But while I was planning to revise that manuscript, I was presented with the draft translation of the second chapter of my book done by Dr. Melissa Calaresu of Cambridge University, when she was still a graduate student. It is probably better to leave aside the story of why Melissa did that translation, but I am extremely grateful to her for having allowed me to use it as the basis for this piece, which is therefore a revised version of the second chapter of my Italian book on Hobbes. I have decided to publish it in English with some hesitation, at least for two reasons. First, because with the publication in English of only part of my book I may risk to reinforce a rather simplified interpretation of my work, and consequently of Pufendorf's thought, that his main contribution lies in his doctrine of socialitas and of the state of nature. I am instead firmly convinced that the most important parts of my own work are those that are still untranslated, that is those on the nature of moral obligation and that of moral entities, beside the comparison I make in the second part of the book between the first and the second edition of De iure. Secondly, because during the intervening years I have distanced myself from a conception of the history of philosophy understood as an internal analysis of the texts, and have become more attentive to the context in which to place philosophical texts. I have therefore developed a slight impatience towards the rather nick-picking analysis of texts, which with a certain virtuosism I performed in the book. Nonetheless, since even after so many years I do not believe that the theses I developed in that book have lost their force, I am happy for this partial translation, with some essential bibliographic updating, to appear, in the hope that such theses will be finally discussed for what they are and not on the basis of second-hand reports. I am grateful to Dario Castiglione for his precious help with the final revision of the text, and to Richard Whatmore and Brian Young for their willingness to publish this translation in their Journal. Does school teach peace? School is a place where we learn values and attitudes - a transmission belt - a social institution that can generate common standards and moral ideals from how we learn (pedagogy) and what we learn (curriculum). This mixed-method analysis utilizes directive (qualitative) and summative (quantitative) content analysis to scrutinize the national curricular statements of England (Early Years Learning and Stage 1-4) to explore whether three elements common in peace education programs appear: recognition of violence (direct, structural (...) or cultural); addressing conflict nonviolently; and, creating the conditions of positive peace. It finds limited evidence in both documents that the English National Curriculum contains content conducive to creating positive peace, minimal content that transmits techniques for transforming conflict nonviolently, and, despite abundant examples of violent acts, there is either norecognition of violence (Stage 1-4) or primarily nominal references to direct violence (Early Learning). Historically, scientists in training have learned the rules of ethical conduct by the example of their advisors and other senior scientists and by practice. This paper is intended to serve as a guide for the beginning scientist to some fundamental principles of scientific research ethics. The paper focuses less on issues of outright dishonesty or fraud, and more on the positive aspects of ethical scientific behavior; in other words, what a scientist should do to maintain a high level of ethical (...) conduct in research.There are a number of fairly specific rules, guidelines, or commonly accepted operating principles that have evolved for the ethical conduct of science. In order to discuss this code of ethics, this paper is divided into sections dealing with specific areas of scientific ethics. These areas are: data collection and storage, ownership of data, confidentiality, communication, authorship, collaboration, the peer review system, and rules of dealing with ethical complaints. Illustrative case histories are presented to provide examples of the type of ethical dispute or problem being discussed. If scientific trainees learn the accepted rules of behavior that govern the conduct of science, ethical problems that arise out of ignorance, misunderstanding, or poor communication can be avoided. Psychology has had difficulty accounting for the creative, context-sensitive manner in which concepts are used. We believe this stems from the view of concepts as identifiers rather than bridges between mind and world that participate in the generation of meaning. This paper summarizes the history and current status of concepts research, and provides a non-technical summary of work toward an ecological approach to concepts. We outline the rationale for applying generalizations of formalisms originally developed for use in quantum mechanics to (...) the modeling of concepts, showing how it is because of the role of context that deep structural similarities exist between the two. A concept is defined not just in terms of exemplary states and their features or properties, but also by the relational structures of these properties, and their susceptibility to change under different contexts. The approach implies a view of mind in which the union of perception and environment drives conceptualization, forging a web of conceptual relations or ‘ecology of mind’. (shrink)

The occasion of this talk was a panel discussion ending the conference on “Radical Politics” sponsored by The University of North Dakota’s chapter to Students for a Democratic Society. Many of the members are self-described Marxists and Anarchists. It is they whom I address here.

Some children seem different, detached, disinterested in the games of other children. They prefer their hobbies to friends of their own age and if forced into community activities, as they often are at school, can become aggressive and difficult. In _Loners_, Sula Wolff describes a childhood personality syndrome that has frequently been neglected. Often using children's own words, their lives and problems become real as she unwraps their stories from first referral to adulthood. Some have become talented and successful adults, (...) whilst others are less fortunate in later years. Carefully documented and meticulously researched, this study makes compelling reading. Children's imitation of adults plays a prominent role in human cognitive development. However, few studies have investigated how children represent the complex structure of observed actions which underlies their imitation. We integrate theories of action segmentation, memory, and imitation to investigate whether children's event representation is organized according to veridical serial order or a higher level goal structure. Children were randomly assigned to learn novel event sequences either through interactive hands-on experience or via storybook. Results demonstrate that children's representation of (...) observed actions is organized according to higher level goals, even at the cost of representing the veridical temporal ordering of the sequence. We argue that prioritizing goal structure enhances event memory, and that this mental organization is a key mechanism of social-cognitive development in real-world, dynamic environments. It supports cultural learning and imitation in ecologically valid settings when social agents are multitasking and not demonstrating one isolated goal at a time. (shrink)

The WHO Commission on the Social Determinants of Health revealed that there is a 28-year disparity between the life expectancy in the poorest postcode and the richest postcode of Glasgow (CSDH, 2008). There are two sets of questions that it is important to ask about health inequalities like these: first, epidemiological questions about the mechanisms that cause inequalities in health and the measures that are effective in reducing them. Second, normative questions about which inequalities in health are wrong and why (...) they are wrong. The papers in this symposium result from the inaugural conference of UCL's Centre for Philosophy, Justice and Health (CPJH) and focus on the relationship between these epidemiological and normative questions. A relatively high incidence of unsatisfactory review decisions is widely recognised and acknowledged as ‘the peer review problem’. Factors contributing to this problem are identified and examined. Specific examples of unreasonable rejection are considered. It is concluded that weaknesses of the ‘peer review’ system are significant and that they are well known or readily recognisable but that necessary counter-measures are not always enforced. Careful management is necessary to discount hollow opinion or error in review comment. Review and referee functions should (...) be quite separate. (shrink)

ZusammenfassungDie von einem multiprofessionellen Behandlungsteam durchgeführte Symptombehandlung bei inkurablen Patienten am Lebensende erweist sich als hoch effektiv und verschafft den meisten Patienten eine ausreichende Linderung. Dennoch verbleibt ein Patientenanteil, bei dem auch unter Berücksichtigung physischer, psychischer, sozialer und spiritueller Bedürfnisse kein erträglicher Zustand erreicht werden kann. In diesen Extremfällen können Sedierungsmaßnahmen zur Linderung eingesetzt werden. Der Begriff und das Angebot der terminalen Sedierung sind in vielerlei Hinsicht umstritten. Eine Kasuistik soll die Problemstellung veranschaulichen und zeigen, wie die terminale Sedierung von (...) erfahrenen Behandlern als ergänzendes Instrument der Symptombehandlung eingesetzt werden kann, auch wenn sie keine perfekte Antwort auf unerträgliches Leiden in der Sterbesituation darstellt. Im Literaturvergleich werden aktuelle medizinische, rechtliche und psychosoziale Fragen diskutiert. (shrink)

In recent literature, the famous Millikan oil-drop experiment appears as a case of “good scientific judgment” on the one hand, and scientific misconduct on the other. This article discusses different interpretations of the fact that Nobel laureate Robert Millikan’s notebooks show that he eliminated a number of oildrops in his published 1913 paper on the charge of the electron, while reporting that he had included all the drops. Starting with the common source of all Millikan stories, historian of physics Gerald (...) Holton’s 1978 paper, I discuss recent “canned” versions of Millikan-as-misbehaver in books on scientific fraud. Then I examine some versions of Millikan-as-good-scientist, particularly the reconstruction by historian of physics Allan Franklin, and the views of some practicing physicists. Finally, we have an instructive head-on collision between the two standard treatments of Millikan. The problem with canned stories is not only insufficient information; we also lack a realistic evaluation of the role of ethics in science. As a fundamentally knowledge-seeking enterprise, science may harbor an inherent, perhaps irresolvable, conflict between scientific and ethical concerns. (shrink)

Der Beitrag untersucht mögliche Kriterien für die normative Bewertung der künstlichen Ernährung bei nichteinwilligungsfähigen Patienten. Der in der aktuellen Diskussion immer wieder unternommene Versuch, den verpflichtenden Charakter bestimmter Formen der Ernährung aufgrund ihrer Zuordnung zu den Kategorien „Basisbetreuung“ oder „Remedia ordinaria“ zu begründen, erweist sich als naturalistischer Fehlschluss. Die Rechtfertigung der künstlichen Nahrungs- und Flüssigkeitszufuhr setzt vielmehr—wie die jeder anderen medizinischen Maßnahme—voraus, dass ihre Durchführung medizinisch begründet und vom Patienten gewollt ist. Dies trifft grundsätzlich auch auf den nicht mehr einwilligungsfähigen (...) Patienten zu; bei diesem kommt es auf den früher erklärten oder mutmaßlichen Willen an. (shrink)

How an abstract immaterial being is connected to a physical thing has been viewed variously by western philosophers who considered the issue prior to their Muslim counterparts.Muslim theologians and philosophers, however, developed the related discussions which became heated following the translation of logical books and essays throughout the Translation Era.The focus of this article, besides clarifying the ideas raised by Muslim philosophers in this regard,is to shed light on Mulla Sadra's opinion and its influence on the later philosophers, Abd-ul-Razzaq Lahiji (...) in particular.To explain his opinion,Mulla Sadra primarily brings a proof to establish the unity of the soul,and to prove this,he has refuted the reasons used by the opposing philosophers through negation and affirmation.Using negation,he comments on why there can't be a unity of soul, and then refers to his opponent's inability to distinguish between specific unity and generic unity considering the latter equal to vegetable,animal and human spirits.Soul and body,Mulla Sadra reiterates,are attached to each other in two ways; in one way,soul is attached to body and yet it is contingent on itself and not on the person's being; in the other way,soul is attached to body while the person's potentialities are actualized; this second type of attachment relates to obtaining existential virtues.It must be noted that Mulla Sadra's belief in these two types of attachment results from his belief in the trans-substantial motion in which soul is also involved.Mulla Sadra works out a solution to the question of relation between soul and body and their effects on one another by proposing the mediation of a veiled spirit, since the soul which belongs to a world of pure light does not involve itself directly in the affairs of the dark body. The veiled spirit is as subtle as the non-material soul and as corporeal as it needs in connectionwith body.This view has been argued by Allameh Tabatabii who thinks corporeal qualities and ontological status must be kept separated and not be mixed.Lahiji,on the other hand, seems to have accepted Mulla Sadra's idea looking at it as a philosophical question,not a medical case. He,like Mulla Sadra, while considering unity for soul, thinks of it as having properties such as sensation imagination estimation intellection. According to Lahiji,the unity of soul and body is like the unity of matter and form; however,unlike natural forms,it does not subsist in matter and interestingly,this notion resembles Neo-Platonist views. Résumé Le cadran solaire analemmatique est présenté pour la première fois par un mathématicien français, appelé Vaulezard, dans un petit fascicule publié en 1640. Suit un deuxième ouvrage, plus complet, en 1644. Dernier venu, ce cadran attire l'attention d'importants savants tels que Foster et Lalande. Parfait dès le départ, il a néanmoins la singulière particularité d'inspirer diverses tentatives d'amélioration, plutôt infructueuses, et d'être à l'origine de quelques variétés de cadrans analemmatiques qui, elles, connaissent un franc succès. Nous apportons la preuve (...) trigonométrique et, pour la première fois semble‐t‐il, la preuve géométrique de sa validité astronomique en suivant fidèlement la méthode de construction indiquée par Vaulezard. Nous effectuons, en outre, un survol aussi exhaustif que possible des différents modèles dérivés de ce cadran ainsi que de la littérature les concernant. Summary The analemmatic sundial was briefly presented for the first time in 1640 by the French mathematician Vaulezard and was described in more detail by him in 1644. The analemmatic dial is the last genuine sundial to be invented and it has attracted the attention of some important scholars such as Foster and Lalande. Although perfect from the very beginning, it had the unusual particularity of inspiring several unfortunate attempts at its improvement as well as being at the origin of a few other types of analemmatic dials, which met with a certain success. We provide here the trigonometric proof and for the first time, the geometric proof of its astronomical validity by closely following the construction method of Vaulezard. We also make a comprehensive survey of the different kinds of analemmatic sundials and of their literature. (shrink)

Most of us care about certain people and things, and some of these concerns become personal commitments, involving our values, our relationships, our work and our religious or political stances. But what is commitement, and why should it matter? Is social commitment - for example, to the family - being eroded by individualism or ironic detachment? And how should we deal with the potential tension between devotion to a life-stance, and the doubts prompted by pursuit of rational integrity? In this (...) work, Piers Benn delves into the relationship between commitment and meaningful life, and asks whether commitment must be based on truth to provide such meaning. He also explores obstacles to commitment such as boredom, sloth and indifference. Drawing on his own experience of dithering and procrastination, he suggests that a sceptical, cautious attitude to important matters can be both a virtue and a real obstacle to human fulfillment. This paper examines two models of thinking relating to the issue of the right to die in dignity: one takes into consideration the rights and interests of the individual; the other supposes that human life is inherently valuable. I contend that preference should be given to the first model, and further assert that the second model may be justified in moral terms only as long as it does not resort to paternalism. The view that holds that certain patients are not (...) able to comprehend their own interests in a fully rational manner, and therefore ‘we’ know what is good for these patients better than ‘they’ do, is morally unjustifiable. I proceed by refuting the ‘quality of life’ argument, asserting that each person is entitled to decide for herself when it is worth living and when it is not. In this connection, a caveat will be made regarding the role of the family. (shrink)

It is difficult to translate the title “Wissen und Glauben” (Knowledge and Faith, see Romans 11:33 and I Corinthians 13:13) into English, because there ist a debate between Kant, Jacobi, Fichte and Hegel behind it. Through Fichtes “Wissenschaftslehre” knowledge has been accepted as the basic element of all scholarship, whereas faith belongs to religion.

In den westlichen Industrienationen gilt das Prinzip der informierten Einwilligung als das Zentralelement medizinischer Forschungsethik. In anderen, stärker die Relationalität als die Individualität von Personen betonenden Kulturen hingegen werden medizinische Entscheidungen traditionell eher durch die Gemeinschaft bzw. ihr Oberhaupt getroffen. Um verschiedenen kulturellen Normen gerecht zu werden, wird international tätigen Forschungsteams häufig empfohlen, den Community Consent und den Informed Consent einzuholen. Ausschlaggebend soll dabei letztlich der Informed Consent des Individuums sein. Es soll die Teilnahme auch dann verweigern können, wenn die (...) Gemeinschaft bzw. ihr Repräsentant dem Vorhaben zugestimmt hat. Der Beitrag diskutiert, ob eine solche Kopplung von Community Consent und Informed Consent tatsächlich geeignet ist, den Ansprüchen beider Prinzipien gerecht zu werden. Es wird argumentiert, dass die Kopplung von Community Consent und Informed Consent ethisch problematisch ist, wenn der Gemeinschaft hierbei ein Vetorecht eingeräumt wird, das geeignet ist, die Realisation konträrer individueller Interessen und damit das Selbstbestimmungsrecht der Betroffenen zu unterlaufen. Um zu gewährleisten, dass in interkulturellen Forschungszusammenhängen sowohl der individuellen als auch der relationalen Autonomie von Personen angemessener Raum gewährt wird, wäre es empfehlenswert, den Informed Consent ausdrücklich mit einer Community Consultation zu koppeln. Hier käme die Entscheidung gegen, aber auch für eine Studienteilnahme in letzter Instanz klar dem Individuum zu, während die Vorzüge einer Einbeziehung der Gemeinschaft in den Entscheidungsfindungsprozess anerkannt und genutzt werden könnten.
